Unemployment benefit for a year. How much do they pay at the labor exchange? What is the allowance at the employment center? Minimum and maximum unemployment benefits, calculation of benefits

Unemployment benefit in 2014

Publication date 20.02.2014

When the search for a job does not bring fruitful results, when the reduction caught a year before retirement, when a young specialist cannot get a job in his specialty, the state has provided a small financial support. Persons recognized as officially unemployed are entitled to benefits. It can be issued only in case of registration at the labor exchange (employment service). The amount of the allowance is calculated in accordance with the period the citizen has been in this status. The billing period is one year. In case of interruption of status, employment, and then re-registration of benefits, a total period of 18 months is taken into account.

The amount of unemployment benefits in 2014

Unemployment benefits are regulated by federal law. In 2014, it will amount to 850 - 4900 rubles. The minimum and maximum levels will depend on each individual case.

Standard dismissal, not burdened with cases specified in the law, is recorded by employees of the employment center when registering. The calculation is based on average earnings, provided that a person has worked for at least 26 weeks. In the first three months, the allowance is paid in the amount of 75% of the average earnings, the next four - 60%, then - 45%. Payments are increased by the value of the district coefficient, which is the difference depending on the region of residence. After 12 months, the payment does not take into account the average income of the applicant, and is minimal. Only officially confirmed income is taken into account.

Special cases when the minimum unemployment benefit (increased by 15%) is paid are prescribed in the law. These include:

Dismissals under the article;

Previously unemployed citizens (first-time seekers);

A long break in labor activity - more than a calendar year;

Having a paid job before registering as unemployed for less than 26 weeks;

Dismissal from work, earlier than 12 months after the last listing on the stock exchange;

Expulsion for no good reason from advanced training courses or other training programs in the direction of the employment service.

How to register with the employment service?

I agree with the order of the Ministry of Health and Social Development Russian Federation from 05.07.2006 No. 513 "On approval of the Administrative Regulations Federal Service on Labor and Employment of the Population for the Provision of Public Services to Assist Citizens in Finding Suitable Jobs, and to Employers in the Selection of the Necessary Workers”, employees of the employment service are obliged to accept a citizen who has come to register on the day of application. There is no pre-registration! Refusal to register is justified only if an incomplete package of documents is provided. For first-time applicants who have never worked anywhere, a passport of a citizen of the Russian Federation, a document on education and a corresponding application are sufficient.

Other persons are required to present the following documents:

Statement of the established form;

Passport of a citizen of the Russian Federation;

Employment history;

Documents on education, professional qualifications. That is, all available diplomas and crusts;

For invalids - individual program rehabilitation;

Certificate of income in the form of 2-NDFL. Pay attention to the correctness of its filling. The name of the organization must be written in full, including the abbreviation of ownership (LLC, OJSC, IP, PE). The certificate is certified by the signature of the chief accountant of the enterprise. In case of absence, by the person replacing him. In this case, a mark is made by the personnel department with the number of the order on the assignment of duties.

Lack of a steady income can destabilize anyone's life. A person's lack of work is not always his fault. Therefore, the state has taken upon itself the obligation to help a citizen in finding a job and provide him with material support while he is looking for a new job. Unemployment benefits in 2014 are paid to persons who were officially recognized as unemployed and are registered as job seekers in the employment service.

Unemployment benefit: terms of appointment and amount

The amount of unemployment benefits is determined by the presence of many factors: seniority, salary, reason for dismissal. In addition, each region has its own coefficient, by which the allowance established by law increases. The regulations of the Russian Federation provide for a minimum unemployment benefit of 850 rubles, and a maximum of 4,900 rubles. The following citizens receive the minimum payments:

Persons looking for a job for the first time;

Dismissed under the article;

If a break in the length of service for citizens is more than a year;

Rehabilitation program (for the disabled);

A document on the amount of salary (certificate), drawn up in accordance with the requirements of the law.

Unemployment benefitis a measure of state support for citizens who do not have a source of income. Unemployment benefits are calculated according to certain rules. To whom and in what amount it can be assigned, will be discussed in this article.

Unemployment benefits in Russia: to whom is it paid?

Unemployment benefits are due to unemployed citizens who are registered with the employment service. The purpose of its payment is to provide a person with a livelihood for the period of looking for a job. However, each unemployed person needs to consider one important point- the payment of benefits has a time frame. If he will be listed as unemployed for a long time, then there will come a moment when the allowance will cease to be paid. This rule is necessary to encourage citizens to actively search for work.

The rules for the appointment and payment of benefits are regulated by the law "On the employment of the population in the Russian Federation" dated 19.04.1991 No. 1032-1.

Persons at least 16 years of age who:

  • do not study full-time;
  • not employed;
  • not appointed or elected to a paid position;
  • do not work under contracts of a civil law nature, incl. they do not sell products obtained in the course of subsidiary crafts under contracts;
  • are not temporarily absent from work for good reasons (vacation, retraining and other reasons are taken into account);
  • not registered as an individual entrepreneur;
  • are not founders, members commercial organizations(except for some, for example, homeowners associations);
  • do not receive a pension for old age or for years of service;
  • are not engaged in subsidiary fishing with the subsequent sale of products;
  • do not perform military or equivalent service;
  • are not members of the farm.

The allowance is accrued from the day the citizen is recognized as unemployed. But there is one exception here. The fact is that if an employee was fired due to a reduction, then the average salary is retained for him for a certain period. In this case, unemployment benefits will begin to be paid only after the employee ceases to receive average earnings from the last place of work.

Citizens who have lost their jobs for any reason, including when they leave work of their own free will and when they are fired for disciplinary offenses, have the right to receive unemployment benefits. However, the reason for dismissal can significantly affect the amount of payments. Citizens who did not have an official job before being registered for unemployment are also entitled to receive benefits, but it will be assigned in the minimum amount.

Unemployment benefits: will there be indexation?

Unlike most government payments, which are indexed annually to inflation, unemployment benefits have not increased since 2009. Every year, the Government of Russia adopts a resolution on the amount of the minimum and maximum benefits, and these amounts do not change from year to year. This situation causes bewilderment among the people also because the size of even the maximum allowance is much lower than the subsistence minimum in the country (in the regions, the minimum in 2017 varies between 7,460 (Kursk region) - 19,000 rubles (Chukotka Autonomous Okrug)). In addition, payments to the unemployed in foreign countries are often much higher than the amount of benefits in our country.

The authorities, in particular the Ministry of Labor, explain the stability of the unemployment benefit by three main reasons:

  • an increase in the amount of payments may encourage citizens to leave their jobs in order to receive state benefits;
  • according to official statistics, the number of vacancies exceeds the number of the unemployed, so they are likely to be quickly employed, which means that they will only have to live off the allowance for a short time;
  • an increase in the amount of the benefit will entail significant budget expenditures, which can only be compensated by reducing the benefit payment period.

For these reasons, the minimum and maximum benefits for 2017 were approved by the Government in the same amounts as in the previous year.

How much money do the unemployed get? The amount of unemployment benefits 2017-2018

As a general rule, the amount of unemployment benefit is determined depending on the average salary at the last place of employment. For some unemployed, this rule cannot be applied. For example, to those who previously did not have an official job. Therefore, for citizens who want to find a job for the first time, and in some other cases, the amount of the benefit is fixed - it is paid in the minimum amount.

Don't know your rights?

To calculate the amount of unemployment benefits, only white wages are taken into account, which is confirmed by the established form (2-NDFL). A salary certificate must be obtained from the accounting department of the organization in which the unemployed previously worked.

When calculating the amount of the benefit, it must be borne in mind that it has a set maximum amount. In 2017-2018 the maximum possible benefit amount is 4,900 rubles. In the northern, Siberian, Far Eastern regions of our country, as well as in the Urals, increasing coefficients are provided. When calculating benefits in these regions, its maximum amount is increased by the corresponding coefficient.

The allowance is paid during the year and accrued in the following amounts:

  • the first 3 months - 75% of the average salary;
  • the next 4 months - 60%;
  • the remaining 5 months - 45%.

If, when calculated as a percentage of average earnings, the benefit is less than the minimum, then it will be accrued in the minimum amount.

The allowance as a percentage of earnings is paid for no more than a year. Then within 6 months the unemployment benefit will not be paid. If a citizen does not find a job, then after 1.5 years from the date of registration, he will receive the minimum allowance.

Minimum unemployment benefit 2017-2018

Currently, the minimum unemployment benefit is 850 rubles. In those regions of our country where regional coefficients are established, this size increases accordingly.

The allowance in the minimum amount is assigned to the following categories of the unemployed:

  • persons who are looking for a job for the first time (this includes, in particular, graduates of professional educational institutions; school graduates who entered to study at the correspondence department; workers who worked without official registration);
  • citizens who, before being registered for unemployment, did not work for more than 1 year;
  • individual entrepreneurs who have been deregistered;
  • employees dismissed “under the article” for illegal actions: appearing at work in a state of intoxication, absenteeism, etc.;
  • persons who worked less than 26 full weeks prior to their dismissal (if the employee worked part-time, then the time worked by him is recalculated at the rate of 40 hours of work = 1 full week);
  • unemployed, sent by the employment center for training and expelled for misconduct.

The payment of the minimum allowance to the listed persons is carried out within six months. If, after 12 months from the date of recognition as unemployed, a person still has not found a job, an allowance in the amount of 850 rubles. will be paid for another 6 months.

For other unemployed persons, the allowance is calculated at a minimum amount under the following conditions:

  1. For 12 months they received benefits as a percentage of earnings, and then there was a 6-month break in the payment of benefits.
  2. 18 months have passed since the registration with the employment service.
  3. During this period, they were never employed.

Unemployment benefits in the minimum amount will be paid to this category of the unemployed for no more than 12 months.

Can the benefit be reduced?

The unemployed registered with the employment center are required to comply with certain rules: to appear for re-registration in a timely manner, undergo training in the direction from the center, participate in paid public works, etc. For failure to fulfill obligations, sanctions may be imposed on a citizen, up to the termination of payment benefits.

One of the types of sanctions is the reduction of unemployment benefits by 1/4. This can happen in 2 cases:

  • failure to appear at the employment center for referral to study or work;
  • failure to appear within 3 days (from the date of receipt of the referral) to the employer to discuss the possibility of employment.

Such behavior of the unemployed will be considered a violation if there were no good reasons for not appearing. To confirm that the violation of the deadline was forced, the employment service will have to submit the available documents (for example, a summons to the court, to the investigator or to the military registration and enlistment office, a certificate of incapacity for work, etc.). In addition, it will not be superfluous to warn the employment service specialist in advance that it will not be possible to fulfill the obligation on time.

The amount of the benefit paid is reduced for a short period - no more than a month. In case of a repeated violation, the amount of the benefit may be reduced again. Both the allowance calculated as a percentage of average earnings and the minimum allowance can be reduced. An order is issued by the head of the employment center to reduce the amount of payment, with which the unemployed must be familiarized against signature.

Benefit amount in Moscow

The amount of unemployment benefits in the capital is determined by the same rules as throughout the country. The minimum and maximum benefits are the same as in other subjects of the Russian Federation. However, unemployed residents of the capital who are registered with the employment service, in addition to the allowance itself, receive a certain allowance from the city budget. Its amount corresponds to the minimum allowance established by the Government of the Russian Federation. In other words, in 2017-2018. residents of Moscow in addition to unemployment benefits calculated according to general rules, receive a payment of 850 rubles. It was established by the Decree of the Moscow Government dated January 27, 2009 No. 47-PP.

Such an additional payment is calculated from the same moment as the allowance. In case of suspension or termination of the accrual of benefits, the payment of the "Moscow allowance" is also not carried out. But reducing the amount of benefits by 1/4 will not affect the additional payment.

The supplement is canceled if an unemployed resident of the capital:

  • refused 2 job options suitable for him in terms of location and qualifications;
  • does not have a profession, is looking for a job for the first time and at the same time has refused public works or training;
  • refused to study despite the fact that employers refused to hire him three times due to insufficient qualifications.

In addition to the additional payment to unemployment benefits in Moscow, a number of measures are provided to support unemployed citizens:

  1. Reimbursement of travel expenses in public transport. It is paid for the period when a citizen receives unemployment benefits. Its size is 1/2 of the cost of a single ticket. The payment is made monthly along with the allowance.
  2. Financial assistance during the illness of an unemployed person who has ceased to receive benefits. A citizen can receive such assistance if the period for payment of benefits to him has expired. To do this, you will need to issue a sick leave issued to the employment department of the Employment Center of the capital district. The payment is calculated based on the amount of the minimum unemployment benefit: if a citizen was on sick leave for 1 month, then he will be paid 850 rubles; if the period of illness was less than a month, then the amount of the payment is reduced accordingly; if more than a month - increases.
  3. A one-time payment in the event of the death of a family member of the unemployed person or himself (in this case, the amount is paid to one of the family members). The amount of the payment is the maximum amount of the benefit (4,900 rubles). To receive assistance, you must contact the employment service with a statement and attach a copy of the death certificate.

The minimum and maximum unemployment benefits for 2014 have been approved. On October 30, 2013, the Government of the Russian Federation signed the corresponding.

Yes, in 2014 the minimum unemployment benefit will be 850 rubles, and the maximum - 4900 rubles. This allowance has not changed since 2009.

As the press service of the Ministry of Labor of Russia notes, the stability of the unemployment benefit is associated with increasing chances for employment due to low unemployment and a high need for workers. Currently, the number of vacancies announced by employers to the regional employment service is twice the number of citizens registered as unemployed in the employment service.

Recall that in accordance with paragraph 1 of Art. 30 of the Law of the Russian Federation of April 19, 1991 No. 1032-1, unemployment benefits are paid to laid-off citizens and are set as a percentage of the average earnings calculated over the past three months at the last place of work. The benefit is paid if, during the year preceding the onset of unemployment, persons had at least 26 weeks of paid work on a full-time or part-time basis, converted to 26 weeks of full-time work. In other cases, the allowance is established in the amount of its minimum amount.

The authority to annually determine the amount of unemployment benefits is vested in the Government of the Russian Federation (clause 2 of article 7 by the law of the Russian Federation of April 19, 1991 No. 1032-1).

The amount of unemployment benefit in case of dismissal

There are general and special cases of unemployment benefits - their size varies. It all depends on whether you worked before, for what reason your employment contract was terminated and how long you worked.

Typical case:
The employee is dismissed for any reason, except for special cases stipulated by law. Suppose that in the period 12 months before the dismissal, the person had a paid job for at least 26 calendar weeks. If this citizen applies to the employment service for the appointment of unemployment benefits, then the amount of his benefits will be calculated as follows.

In the first annual benefit cycle.
For the first three months, the allowance must be paid in the amount of 75% of the average monthly earnings of the unemployed person (we are talking about the average earnings for the last three months at the last place of work); in the next four months, the allowance should be paid in the amount of 60% of the average monthly earnings of the unemployed, and then - in the amount of 45%. In any case, the benefit will be paid in an amount not more than the maximum and not less than the minimum unemployment benefit, increased by the size of the district coefficient.

in the second annual cycle.
The allowance is paid in the amount of the minimum unemployment benefit, increased by the district coefficient.
Keep in mind that only the official part of the salary can be used to calculate the amount of unemployment benefits, i.e. "white" salary.

Special cases for determining unemployment benefits:

If a citizen:

  • looking for a job for the first time (has not worked before);
  • wants to work after long break(more than 1 year);
  • was fired for violating labor discipline;
  • was fired from a job during the 12 months prior to unemployment and had less than 26 weeks of paid employment during that time;
  • was sent by the employment service for training and expelled from there for guilty actions.
The amount of unemployment benefit in these cases will be:

In the first semi-annual cycle of the benefit period:
the minimum amount of unemployment benefits, increased by the district coefficient.
In the second semi-annual benefit cycle:
the minimum amount of unemployment benefit, increased by the size of the district coefficient.
